India is today the land where officers of the law, both executive and judicial, murder it in the mass. They pronounce heavy sentences of imprisonment without fully reading the sections under which they do it so. Sections of ordinary law, for instance section 107 which is meant to prevent offence, have been misused for punitive purpose to punish offences, and sections of special laws, for instances, section 7 of criminal law Amendment Act, which is meant to protect private property have been used for the protection or use public property. What is at most mischief involving a sentence of less than a week has been punished as a criminal offence with six months or more. This has happened not in one case or ten, but in hundreds of cases. We hope that the government or High Court will take of this wide spread daughter of the law and set aside at least now the effect of such faulty judgments. Need has also arisen to decide whether these sections are not contrary to the Constitution of the republic.
