Each individual makes several agreements everyday. On the basis of mutual agreements, there are so many such dealings which create the awareness of mutual liability. There is also special significance of these dealings from the legal point of view. In connection with the 'agreement', there" have been given various scholars.
according to Chetty, "An offer, duly accepted, constitutes an agreement". According to Pollock. "An agreement contemplates something to be done or forborne by one or more of the parties for the use of other or others".
According to Leake, "An agreement consists in two persons being of the same intention concerning the matter agreed upon'. According to Sec. 2(e) of the Indian Contract Act, "Every promise and every set of promises, forming the consideration for each other, is an agreement".
From the above definitions of 'agreement' it is clear that for an agreement, there is the need of a 'promise' or a set of promises. The word 'promise', has been defined in Sec. 2(7) of the Indian contract Act as, "When one person the same becomes a 'promise'. Thus for the fulfilment of a promise, the proposal and its acceptance is necessary.
