Learned counsel states the propriety demands that a person who himself had been an advocate for a party to a matter needs to refrain from passing judicial order on elevation as Judge or the High Court. When we confronted learned counsel for the respondents with this situation in this matter, all of the them agreed that Mr. Khalid Ali who had appeared as counsel in the Court ought not have passed the judicial order dated and should have disassociated himself.
Be that as it may, as all of them have agreed that the order dated should not been passed by who is now no more Judge of the High Court in our opinion the judgment passed by him as well as subsequently judgment dated passed in both are not sustainable. Thus for the foregoing reasons both in orders dated are not sustainable. This for the foregoing reasons both the order dated and is set aside. Remanded to the learned High Court for disposal for the of the matter expeditiously
be that is it may as all of the them have agreed the the order dated should not have passed by Mr. Khalid who is now up no more Judge of the High Court, in our opinion the judgment passed by him as well as subsequently judgment dated passed in both are not sustainable . Many years on the earlier date it was observed that applications be disposed of as early as could be possible within a period of three months preferably. as it is indicated in the order within a period of the three months preferably, as is therefore, observed that the High Court may depose of the matters preferably within a period of the 6 months . We are confident the the learned Chief Justice shall look into this matter and ensure the compliance of order in letter and spirit this order we have passed in exercise of the jurisdiction under Article of the Constitution.
