It seems that in view of the request made in the above letters election schedule was fixed by the election commission of Pakistan on 2013 for Sindh province what was for passing appropriate orders by the election commission of Pakistan the CMA disposed subsequently changed to 2013 in response of the request was made by the provisional government according to law:-
Through CMA filed by the this Government through this court, therefore, the advocate journal which order was sent to the election commission of Pakistan for appropriate orders contends of the said orders reads as under. This application has been filed on behalf of the Sing Government through learned advocate journal Sindh under order rule this of Supreme Court rules 1980 seeking change of date from 27 December to 7 December 2013 for holding local bodies elections the Learned Advocate Journal Sindh emphasized inter alia that one of the reasons for seeking extension is that the process for holding local government election is commenced and the holidays of assura Muharram Ul Haram therefore, it was constrained to postpone the election similarly representatives of the Ahle Tahiu community also met the chief minister Sindh and expressed serious constrained and request government to move application for adjustment of date of local government election in Sindh he also added that a large member of representative groups from different community have also met the Chief Minister and the same requested, further added that the Sindh Government is fully committed to honour the order passed by the court to observe the constitutional obligation we have pointed out to the Learned Advocate Journal that the dates for local government elections are to be fixed by the considered opinion and the provincial government had constitutional obligation to hold the local government elections for the purpose of allowing the citizens of the country to show participation in the political administration and financial responsibilities of the local government. Therefore, by taking consideration the request was made by the provincial government of Sindh we are referred application to the election commission of Pakistan for considering the application and may accommodate them because in the other province like Punjab and Baluchistan the election are scheduled to the held on 2013, the learned advocate journal made therefore, appear before the ECP during the course of the day that the instant CMZ and this order for passing appropriate orders by the election commission of Pakistan the CMA is deposed accordingly.
However, in the meanwhile in request for change of election schedule has been made either by the province by the province of Baluchistan or by the Punjab Province as for as the province KPK is concerned despite of knowing its constitutional obligation in request has been filed for holding cantonment arise is concerned federal government has requested to the ECP for holding the election in the cantonment and ECP has asked the federal government to fulfill certain requirement and the same will be done in the meanwhile.
