Learned counsel for the petitioners has submitted that petitioners had been falsely involved in this case. In fact, respondent could not qualify the type test on many occasions. Due to this reason, by levelling false allegations, complaint had been filed by the respondent. Further reading of the complaint, itself revealed that the respondent had not stated his caste in the complaint nor had disclosed about the caste of the petitioners. Respondent had further failed to assert that petitioners were aware of the caste of the respondent. Even otherwise, the alleged derogatory words had not been uttered in public view to constitute an offence under the Act.
3. That as per instructions of the State Govt. a Clerk can get increment after passing the Type Test.
4. That a Type Test (English) was fixed for 8-6- 2004 by the accused no.1 and accused nos. 2 & 3 were deputed by the accused no. 1 as examiners. The complainant appeared in the Type Test (English) in the office of D.E.O., Jind on dated 8-6-2004. Typewriting speed passage was served to the complainant upon which 10 minutes were provided for Test and as well as the accused no.2 & 3 also stated to the complainant & other in the examination hall that the time has been fixed only 10 minutes. The complainant typed the passage carefully, accurately within 10 minutes. Later on, the accused nos.2 & 3 under the instructions collusion of accused no.1 a writing was given to the accused no.4, Mange Ram Steno, that marking of this Test will be as per 20 minutes Test. The paper of the complainant was marked as per time of 20 minutes Test, rather the time was provided only 10 minutes. The complainant declared fail illegally, by committing offence U/s 467/468 IPC. 5. That the above wrongful act of the accused persons came to the knowledge of the complainant on dated 26-7-2004 when the complainant with one Devinder Kumar Clerk, O/o Distt. President of Haryana Education Ministerial Staff Association, Jind District, Jind gone to the office of accused no.1 (D.E.O.) to enquire the result of Type Test but on that day the accused no.1 was not present in the office and we met to the accused no.4 and then the complainant asked him about the result of Type Test, he did not listen the complainant properly and not disclosed the result of Type Test. When the complainant said that you are in full knowledge and you are also not telling the result intentionally then the accused became angry on the complainant and used filthy language and abused saying that "DHED-KAMINO, CHURO, CHAMARON KA MAIN KAM NAHIN KARUNGA, TOO KAMIN-DHED HAI" and when the complainant raised objection then the accused caught hold the complainant from the neck and pushed towards the wall and the head of the complainant hit upon the wall and when said Devinder Kumar Clerk said to the accused not to mis-behave with the complainant then the accused Sandeep Sethi 2013.07.20 16:18 I attest to the accuracy and integrity of this document CRM No.M-249 of 2010 no.4 said to the witness Devinder Kumar that you are Jat, why are you accompanying these "KAMIN-DHED". The accused threatened to kill the complainant as and when he got chance and also openly that if you will come back in this office I will get involved you in false case. In the meantime the accused no.4 pushed the complainant outside the office after using filthy language as mentioned above.
9. That no similar complaint is pending or decided by any court of law.
It is, therefore, prayed that the complaint of the complainant may kindly be accepted and the accused may kindly be summoned, tried and prosecuted under law in the interest of justice."
