This petition has been filed by the applicants against the non-applicant under Section 10 read with Section 25 of the Wards and Guardianship Act, 1890 and Section 08 of the Hindu Minorities and Guardianship Act, 1956. The application presented by the applicant is briefly as follows: After his death, the applicants became the owners of his property as legal heirs. Applicant No. 01 wanted to sell the disputed land for the bright future of applicant No. 02 and for her higher education due to her financial circumstances, but there was a provision for permission from applicant No. 02 to get the sale deed done in the sub-registrar office, for which the applicant made several attempts in the Revenue Court, but was asked to present the case in the Revenue Court, the Court. In this way, applicant No. 01 is continuously fulfilling her responsibilities. By this order, the application filed by the accused under section 91 is being disposed of. The prosecution has filed a charge sheet under section 13(1) of the Prevention of Corruption Act, 1988 against the accused alleging that she has assets disproportionate to her income. The income of the accused has been assessed while she was working as a contractor. The advocate on behalf of the accused has prayed for summoning the original records of income tax returns, salary statement, FDR documents related to savings account from the concerned department to prove the income of the accused. The documents which the learned advocate has prayed for summoning have been provided under section 91 of the Cr.P.C. Whenever any court or any officer in charge of a police station considers that for the purposes of such investigation, inquiry, trial or other proceedings which are being conducted by or before such court or officer under this Code, then the accused shall be required to produce the original records of income tax returns, salary statement, FDR documents related to savings account from the concerned department. Issue a Writ of Certification or a writ in the nature of certification or any other appropriate writ, order or direction calling for the records in relation to the issuance of the Look Out.
