The certificate of empowerment may be renewed for a period of three years by the Registrar/District Judge, with prior approval of the empowering authority on an application made in Form No.VII, by the concerned Commissioner, on the deposit of a non-refundable fee of Rs. 750/- through a treasury challan. In exercise of powers conferred by section 3(2)(a) of the Oaths Act, 1969, Articles 225 & 227 of the Constitution of India, Sections 122 and 139(b) of the Code of Civil Procedure, 1908 (5 of 1908), Sections 477(I)(d) and 297(I)(b) of the Code of Criminal Procedure, 1973. Clauses 27 and 23 of the Letters Patent and all other powers enabling it in this behalf, the High Court of Madhya Pradesh hereby makes following Rules to empower an advocate to function as Commissioner of Oaths for the High Court and all matters incidental thereto. Every application for being empowered as the Commissioner of Oaths for the High Court shall be made in Form-I within 15 days from the date of notification of vacancy and shall be accompanied by a non-refundable fee of Rs. 100/- payable through a postal order in the name of the Registrar General of the High Court of Madhya Pradesh, Jabalpur. The empowering authority shall, at its discretion, empower advocate as Commissioner of Oaths for the High Court, out of the panel mentioned under sub-rule (ii) of rule XII-(A), the Commissioner of Oaths for the High Court shall use a circular seal of the diameter of 5 c.m. bearing his name and name of the civil district for which he has been empowered to exercise his function and the circumscription "Commissioner of Oaths for the High Court". The Commissioner of Oaths for the High Court shall affix his signature and the seal, mentioned under sub-rule (i), on every page of the affidavit and every page of the petition, application, return, rejoinder or other document, supported by such an affidavit. It shall be the duty of Commissioner of Oaths for the High Court to ensure that the affidavit is drawn up and verified strictly in accordance with the rules, pertaining to affidavits as contained in the High Court of Madhya Pradesh Rules.
